TSS Software Corporation (“us,” “we” or “our”) created this Web Site Privacy Policy ("Privacy Policy") to familiarize you with how we collect, use and disclose Personal Information (as described below). This Privacy Policy describes our online privacy practices in connection with Personal Information collected or submitted through the Web sites that post or link directly to this Privacy Policy (collectively, the "Site") and the various services (collectively, the "Services") we provide on or through the Site.

By using the Site or the Services, or by providing any Personal Information using the Site or the Services, you are agreeing to the collection and use of such information in the manner described in this Privacy Policy. If you do not agree to the terms and conditions of this Privacy Policy, please do not provide us with any Personal Information.


  1. Types of Information Collected

    1. Personal Information. In order for you to access or use certain Services we offer via the Site, we require you to provide us with information that personally identifies you ("Personal Information"). Personal Information may include: (i) contact data (such as your name, telephone number, facsimile number, mailing and e-mail addresses and employer name and address) and (ii) financial data (such as your bank account number or credit card number and expiration date). Some of the information we ask you to provide is identified as “required” and some as “voluntary.” If you do not provide the required information, you may not be able to use all the Services. If you communicate with us via e-mail, chat with a representative online, post messages to any of our chat groups, bulletin boards or forums, or otherwise complete online forms or surveys, any information provided in such communications may be collected as Personal Information.
    2. Nonpersonal Information. This is any information that does not reveal your specific identity, including aggregated information and demographic information (such as your ZIP code; information about your employer, such as company size and number of employees; and information about products and services currently used). We and our third-party service providers may collect Nonpersonal Information from you, including your Internet protocol (“IP”) address, your media access control (“MAC”) address, your computer type, screen resolution, operating system (“OS”) version, Internet browser, cookies, pixel tags, Web beacons, and other similar technologies to better serve you with more tailored information and facilitate your ongoing use of the Site. We and our third-party service providers may also collect Nonpersonal Information such as demographic data (e.g., your location) and Personal Information that has been aggregated in a manner such that the end-product does not personally identify you or any other user of the Site (e.g., using Personal Information to calculate the percentage of our users who have a particular telephone area code).     3. Account Data. During the use of certain Services we offer via the Site, information that personally identifies third parties (“Account Data”) may be provided by you and stored by the Services. Account Data is information pertaining to the borrower, buyer, seller, lender and other third parties and that is required to complete the HUD-1 and other real estate title and settlement forms. Account Data may include: (i) residence data (such as name and address of third parties), (ii) property data (such as property location and legal description of property owned by third parties), and (iii) cost data (such as costs of goods and services, payments or amounts owed to third parties, taxes paid or owed, and other financial data about third parties).

  2. Uses of Information Collected

    1. Personal Information.
    • Internal Uses. We use contact data to: (i) send you information about our company or our products or services, (ii) inform you of news or events we believe will be of interest to you, (iii) create your Site and Services user accounts, (iv) fulfill your requests (such as, to send you newsletters or complete your purchases), or (v) respond to your inquiries or contact you. We may also use contact data to send you important information regarding the Site or Services, changes to our terms, conditions, and policies or other administrative information. Because this information may be important, you may not opt-out of receiving these communications. We use your financial data to verify your qualifications for certain products or services and to process financial transactions for products and services you order through the Site and Services.
    • Promotions. We may offer you opportunities to participate in special promotions ("Promotions") through the Site. We typically ask you for certain Personal Information when you enter and, if applicable, benefit from a Promotion. You should carefully review the rules, if any, of each Promotion in which you participate through the Site, as they may contain additional important information about our use of Personal Information about you. To the extent the terms and conditions of such rules concerning the treatment of Personal Information about you conflict with this Privacy Policy, the terms and conditions of such rules shall control.
    1. Nonpersonal Information. Because Nonpersonal Information does not personally identify you, we may use this information for any purpose. In addition, we reserve the right to share Nonpersonal Information with affiliates and other third parties for any purpose. In some instances, we may combine Nonpersonal Information with Personal Information (for example, combining your name with your geographical location). If we combine any Nonpersonal Information with Personal Information, the combined information will be treated by us as Personal Information as long as it is combined.
    2. Account Data. Account Data is stored and maintained for you as part of our Site and Services.

    1. Third-Party Service Providers. We work with third parties who provide products and services in connection with the Site and Services, including, but not limited to, hardware, software, and infrastructure to host data and other services of an administrative nature. If you pay for any products or services available on the Site by credit card or by use of a bank account number, your credit card or bank account information may be disclosed by us to third parties in order to process or otherwise complete your transaction. We reserve the right to share Personal Information and Account Data with such third parties for the purpose of enabling such third parties to provide such products and services.
    2. Sharing with Other Third Parties. From time to time, we may share Personal Information about you with third parties to allow them to contact you regarding products, programs, services and promotions they believe may be of interest to you.     3. Promotions. We reserve the right to share the Personal Information you provide in connection with Promotions with third-party sponsors of such Promotions (irrespective of whether such Promotions are hosted by us) or otherwise in accordance with the rules applicable to such Promotions. You should carefully review the rules, if any, of each Promotion in which you participate through the Site, as they may contain additional important information about a sponsor's or other third parties’ use of Personal Information. To the extent the terms and conditions of such rules concerning the treatment of Personal Information conflict with this Privacy Policy, the terms and conditions of such rules shall control.
    4. Information Posted by Visitors. We may make available through the Site certain functions (for example, message boards, forums, chat functionality and blogs, among other services) to which you could post information and materials. Any information you disclose through such services or otherwise on the Site becomes public information and may be available to visitors to the Site and to the general public. In addition, when you make a posting on such services, certain Personal Information (for example, a link to your profile that contains Personal Information) becomes available for other users to view.     5. Assignment. We reserve the right to transfer any and all information we collect from Site users to an affiliated entity or a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer, or other disposition of all or any portion of our business, assets or stock (including without limitation in connection with any bankruptcy or similar proceedings).
    6. Law enforcement; emergencies; compliance. Notwithstanding any other provision of this Privacy Policy to the contrary, we reserve the right to disclose Personal Information about you to others to the extent we believe such disclosure to be appropriate: (a) under applicable law; (b) to comply with legal process; (c) to respond to governmental requests; (d) to enforce our Terms of Service; (e) to protect our operations or those of any affiliated entities; (f) to protect the rights, privacy, safety or property of us or our affiliated entities, you or others; and (g) to permit us to pursue available remedies or limit the damages we may sustain. For example, we may, to the fullest extent the law allows, disclose Personal Information about you to law enforcement agencies to assist them in identifying individuals who have been or may be engaged in unlawful activities.
  1. User Choice Regarding Collection, Use and Distribution of Personal Information

    You may choose not to provide us with any Personal Information. In such an event, you may still access and use much of the Site; however, you will not be able to access and use those portions of the Site or those Services that require Personal Information. If you do not wish to receive information and promotional material from us, you may select the appropriate "Opt-out" option or link on our online forms each time we ask you for Personal Information.   1. Security of Personal Information

    We have security measures in place to assist in preventing unauthorized access to your Personal Information. We seek to limit access to Personal Information to employees and independent contractors who we believe reasonably need access to that information to provide products or services to you or in order to perform their jobs. Unfortunately, no security system can be 100% secure; accordingly, we cannot guarantee the security of any information we collect online. If you have reason to believe your interaction with us is no longer secure (for example, if you feel the security of any account you might have with us has been compromised), notify us of the problem immediately by contacting us in accordance with Section 14 ("Contact") below (notifying us by physical mail will delay our ability to respond to the problem).

By using the Services, you agree to and acknowledge that Personal Information and Account Data may be transferred across national boundaries and processed outside of your country.

    By logging in to your account on the Site or Services and accessing the Account Management page, you can: (i) obtain a copy of your Personal Information, (ii) correct your Personal Information, and (iii) deactivate your account.
